<strong>local tax that<\/strong> <strong>must be paid by owners<\/strong>, usufructuaries, or individuals with rights over real estate, such as flats, houses, parking spaces, offices, and other properties.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_required_to_pay_the_IBI\"><\/span>Who is required to pay the IBI<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>As previously mentioned, the IBI is paid <strong>by those who hold any of the following rights<\/strong> over properties of any type (rural, urban, or with special characteristics):<\/p>\n\n\n\n<ul>\n<li>From an <strong>administrative concession <\/strong>over the properties or the public services to which they are subject.<\/li>\n\n\n\n<li>From a <strong>real right of surface.<\/strong><\/li>\n\n\n\n<li>From a <strong>real right of usufruct.<\/strong><\/li>\n\n\n\n<li>From the <strong>property right.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>The person responsible for paying is the taxpayer who holds one of the rights <\/strong>listed above.<\/p>\n\n\n\n<p><strong>As a general rule, when the property is rented, it is the owner who must pay <\/strong>the IBI, as established by the Urban Leasing Law (LAU). This is because the property belongs to them.<\/p>\n\n\n\n<p>However, <strong>it is possible for the landlord and tenant to come to an agreement that the tenant will be responsible for part or all of the tax.<\/strong> To do this, a written agreement must specify who will pay the tax, the percentage, and how it will be settled.<\/p>\n\n\n\n<p>It is very important that the agreement is clear and signed by both parties since, <strong>for the competent Administration, the owner is the one responsible for paying the tax <\/strong>and will be held liable for any penalties due to non-payment or delays.<\/p>\n\n\n\n<p>In these cases, <strong>the owner typically pays the tax to the Town Hall and subsequently demands reimbursement from the tenant <\/strong>for their share.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Taxes_paid_by_non-residents_in_Spain\"><\/span>Taxes paid by non-residents in Spain<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>If you own a property in Spain, <strong>even if you do not reside in Spain, you will have to pay taxes related <\/strong>to your property rights.<\/p>\n\n\n\n<p>The taxes that apply in this case are the Real Estate Tax <strong>(IBI), <\/strong>the Income Tax for Non-Residents <strong>(IRNR) <\/strong>and also, in some cases, the Wealth Tax <strong>(IP).<\/strong><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Real_estate_tax_IBI\"><\/span>Real estate tax (IBI)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>As we have already mentioned, <strong>this is a tax levied by the Town Hall<\/strong> of the municipality where the property is located.<\/p>\n\n\n\n<p>It is commonly known as a contribution, and <strong>its amount varies depending on the cadastral value <\/strong>of the property.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Non-resident_income_tax_IRNR\"><\/span>Non-resident income tax (IRNR)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The IRNR <strong>must be paid by the owner of a property <\/strong>located in Spanish territory and residing abroad.<\/p>\n\n\n\n<p><strong>Depending on the use given to the property, the taxable income may vary.<\/strong><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Wealth_tax_IP\"><\/span>Wealth tax (IP)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p><strong>The owner of a property located in Spanish territory is subject <\/strong>to the Wealth Tax (IP) even if they do not have their habitual residence in Spain.<\/p>\n\n\n\n<p>Under current regulations, this tax must be paid, and its <strong>accrual date is December 31 <\/strong>of each fiscal year.<\/p>\n\n\n\n<p>However, it should be noted that <strong>there is a minimum exemption of 700,000 euros,<\/strong> which is also applicable to non-residents.<\/p>\n\n\n\n<p>The form they must use to file their wealth tax return is the same as the one residents submit, <strong>form 714,<\/strong> and it must be filed within the same period as for residents.<\/p>\n\n\n\n<p><strong>This applies to taxpayers whose tax liability results in an amount payable. It is also applicable to those whose assets and rights exceed 2 million euros, <\/strong>even if their tax liability is negative.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_is_the_IBI_calculated\"><\/span>How is the IBI calculated?<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The starting point is the <strong>cadastral value of the property, to which the <\/strong>tax rate set by the Town Hall of the municipality where the property is located is applied.<\/p>\n\n\n\n<p>For the calculation <strong>it would be necessary to take into account:<\/strong><\/p>\n\n\n\n<ul>\n<li><strong>The cadastral value of the property,<\/strong> which adds the value of the land and the value of the construction, which is the taxable base.<\/li>\n\n\n\n<li><strong>The tax rate of each Town Hall,<\/strong> within the margins set by the Local Tax Law.<\/li>\n<\/ul>\n\n\n\n<p>As we have already mentioned, the IBI is a local tax that must be paid by anyone who holds a property right, including non-residents in Spain.
