Sporadic absences are included in this calculation, unless you can prove that you reside in another country.<\/li>\n<\/ul>\n\n\n\n<p>If you come from a tax haven, the Tax Agency may require stricter evidence that you haven&#8217;t spent enough time in Spain.<\/p>\n\n\n\n<ul>\n<li><strong>Your main source of income or financial interests are in Spain.<\/strong> This takes into account whether you work here, own a business, or have major investments in the country.<\/li>\n\n\n\n<li><strong>Your immediate family lives in Spain.<\/strong> For example, your parents and siblings.<\/li>\n\n\n\n<li><strong>If your partner, who is not legally separated, and\/or minor children reside in Spain,<\/strong> the Treasury will assume that you do so as well, unless you prove otherwise.<\/li>\n<\/ul>\n\n\n\n<p>If you meet any of these criteria, <strong>you must file your tax return as a tax resident,<\/strong> and you&#8217;ll be considered as such for all Spanish tax matters.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_if_you_are_not_a_tax_resident\"><\/span>What if you are not a tax resident?<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p><strong>If you do not meet the conditions in the previous section,<\/strong> you will be considered a non-resident for tax purposes and:<\/p>\n\n\n\n<ul>\n<li>only <strong>pay taxes on income earned in Spain.<\/strong><\/li>\n\n\n\n<li>You will pay taxes through the <strong>Non-Resident Income Tax (IRNR).<\/strong><\/li>\n\n\n\n<li>You&#8217;ll have <strong>simpler,<\/strong> fixed-rate taxation, but without the deductions available to residents.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Other_taxes_that_affect_foreigners_in_Spain\"><\/span>Other taxes that affect foreigners in Spain<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In addition to personal income tax, if you are a foreigner residing in Spain, you may be subject to other taxes depending on your specific personal situation and the transactions you carry out in the country.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Wealth_Tax_IP\"><\/span>1. Wealth Tax (IP)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The Wealth Tax applies to individuals with high net worth and <strong>affects assets and rights both in Spain and abroad,<\/strong> if you are a tax resident.<\/p>\n\n\n\n<p><strong>Some aspects<\/strong> to take into account:<\/p>\n\n\n\n<ul>\n<li>It applies to <strong>net assets exceeding 700,000 euros,<\/strong> although there is a minimum exemption that may vary depending on the Autonomous Community.<\/li>\n\n\n\n<li><strong>The habitual residence has an exemption of 300,000 euros.<\/strong><\/li>\n\n\n\n<li><strong>Non-residents only pay taxes on assets located in Spain.<\/strong><\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Non-Resident_Income_Tax_IRNR\"><\/span>2. Non-Resident Income Tax (IRNR)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>In the case of <strong>non-tax residents who earn income in Spain, they will not have to file a Personal Income Tax Return; they will have to pay taxes under the IRNR:<\/strong><\/p>\n\n\n\n<ul>\n<li>It applies to <strong>rents, work income, economic activities and capital gains.<\/strong><\/li>\n\n\n\n<li><strong>The general tax rate is 24% or 19% <\/strong>if you are a resident of the European Union, Norway, or Iceland.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Inheritance_and_Gift_Tax_ISD\"><\/span>3. Inheritance and Gift Tax (ISD)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p><strong>When an inheritance or donation is received in Spain, the Inheritance and Gift Tax applies.<\/strong> This tax varies depending on the Autonomous Community of residence and applies to both residents and non-residents who receive assets in Spain.<\/p>\n\n\n\n<p><strong>There are tax breaks <\/strong>for this tax based on the relationship between the inheritor and the deceased, as well as other types of payment reductions.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Property_Tax_IBI\"><\/span>4. Property Tax (IBI)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p><strong>Owning a home in Spain means you have to pay property tax every year,<\/strong> regardless of whether you live in the country or not.<\/p>\n\n\n\n<p><strong>This tax is local in nature <\/strong>and its amount is calculated based on the property&#8217;s cadastral value.<\/p>\n\n\n\n<p>Although it varies depending on the municipality where the property is located, <strong>the percentage typically applied ranges from 0.4% to 1.3% of the property&#8217;s cadastral value.<\/strong><\/p>\n\n\n\n<p>Some taxes, such as Personal Income Tax, are not the same for foreigners and Spaniards. The difference in these cases lies in whether you are a tax resident or not, depending on the number of days you stay in the country, the activities you carry out, or the family you have residing there. In addition to Personal Income Tax, other taxes also apply to foreigners, such as Wealth Tax, Property Tax, and Inheritance and Gift Tax.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_consequences_of_renouncing_an_inheritance\"><\/span>The consequences of renouncing an inheritance<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The <strong>consequences <\/strong>of renouncing an inheritance are:<\/p>\n\n\n\n<ul>\n<li>of the assets and rights of the inheritance <strong>cannot be accessed.<\/strong><\/li>\n\n\n\n<li><strong>You have to give up everything,<\/strong> it can&#8217;t be done partially.<\/li>\n\n\n\n<li><strong>The portion of the inheritance that is rejected will increase the portion of the inheritance of the legitimate heirs <\/strong>who have accepted it.<\/li>\n<\/ul>\n\n\n\n<p><strong>An alternative to rejecting the inheritance is to accept the inheritance with the benefit of inventory.<\/strong> In the latter case, if the inheritance entails debts, these will not affect the estate of the heirs and will be settled with the assets of the estate itself. The heirs will receive any remaining debt.<strong><\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Acceptance_for_the_benefit_of_inventory_as_an_alternative_to_rejection_of_the_inheritance\"><\/span>Acceptance for the benefit of inventory as an alternative to rejection of the inheritance<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Accepting the inheritance with the benefit of inventory <strong>is a legal option with which the heirs can accept the inheritance without having to face debts,<\/strong> which may even exceed the value of the inherited assets.<\/p>\n\n\n\n<p>This decision protects the heir&#8217;s personal assets.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_acceptance_for_the_benefit_of_inventory_is_carried_out\"><\/span>How acceptance for the benefit of inventory is carried out<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The <strong>steps <\/strong>followed in accepting the inheritance for the benefit of inventory are as follows:<\/p>\n\n\n\n<ul>\n<li><strong>Formal acceptance.<\/strong> The heir must formally express his or her willingness to accept the inheritance for the benefit of inventory.<\/li>\n\n\n\n<li><strong>Inventory.<\/strong> A detailed inventory is made of the estate&#8217;s assets and debts.<\/li>\n\n\n\n<li><strong>Filing before a notary.<\/strong> The inventory is submitted to a notary for approval.<\/li>\n\n\n\n<li><strong>Payment of debts.<\/strong> Debts are paid from the assets of the inheritance.<\/li>\n\n\n\n<li><strong>Distribution of remaining assets.<\/strong> If any assets remain after paying debts, they are distributed among the heirs.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Deadlines_for_acceptance_for_the_benefit_of_inventory\"><\/span>Deadlines for acceptance for the benefit of inventory<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>There are differences in the <strong>deadlines depending on the situation:<\/strong><\/p>\n\n\n\n<ul>\n<li><strong>If the heir already has the inheritance or part of it in his possession,<\/strong> he must communicate his decision within 30 days.<\/li>\n\n\n\n<li><strong>If the heir does not have the inheritance in his possession,<\/strong> the deadline to communicate his decision is 30 days from the expiration of the deadline to accept or reject the inheritance.<\/li>\n<\/ul>\n\n\n\n<p>Accepting or rejecting the inheritance is an important decision because it affects the heir&#8217;s assets. It is advisable to do so in certain cases, such as when there are significant debts or expenses related to the assets. In this case, you will need to consult a notary.
