However, you must take into account certain tax considerations when doing so, primarily regarding the application of <strong>Value Added Tax (VAT)<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Procedures_are_Necessary_for_Invoicing_Foreign_Customers\"><\/span>What Procedures are Necessary for Invoicing Foreign Customers?<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul>\n<li><strong>Intra-Community Operators Register (ROI):<\/strong> If you are going to carry out <strong>supplies of goods or provision of services<\/strong><strong>to other<\/strong><strong>companies or professionals<\/strong> in the European Union (EU), it is <strong>mandatory<\/strong><strong>to register in the ROI to invoice them without VAT<\/strong> (applying the reverse charge rule).\n<ul>\n<li>To complete this procedure, you must submit <strong>Form 036 (Modelo 036)<\/strong> to the Tax Agency (Agencia Tributaria). Once accepted, you obtain a <strong>NIF-VAT<\/strong> (or intra-community VAT number) that must appear on your invoices. You can check if your EU client is registered in the European Commission&#8217;s <strong>VIES<\/strong> system.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Invoices to non-EU customers (outside the EU) or private customers in the EU:<\/strong> Generally <strong>do not require<\/strong> registration in the ROI, but may require other special registrations in the case of EU private customers (see point 2).<\/li>\n\n\n\n<li><strong>Invoice Mention:<\/strong> It is necessary to indicate the applicable regulation on the invoices you issue (e.g., &#8220;Operation exempt under Art. 21 of Law 37\/1992&#8221; for exports).<\/li>\n<\/ul>\n\n\n\n<p>Furthermore, when invoicing foreign customers, it is essential to differentiate <strong>the type of customer and the location<\/strong>:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Professional_Customers_or_Businesses_in_the_European_Union\"><\/span><strong>1. Professional Customers or Businesses in the European Union<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Intra-community customers are considered those who reside or have their registered office in an EU member country.<\/p>\n\n\n\n<ul>\n<li><strong>General Rule:<\/strong> When the issuer (Spanish supplier) and the recipient (EU client) of the invoice are <strong>registered in the ROI\/VIES<\/strong>, the invoice is issued <strong>without VAT<\/strong>. This is the <strong>reverse charge rule<\/strong>, where the VAT is self-assessed in the country of destination.<\/li>\n\n\n\n<li><strong>Declaration:<\/strong> These operations must be included in the VAT <strong>Form 303 (Modelo 303)<\/strong> <strong>and<\/strong> in the <strong>Form 349 (Modelo 349)<\/strong> for intra-community operations (where the sales made are declared).<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Private_Customers_Final_Consumers_in_the_European_Union\"><\/span><strong>2. Private Customers (Final Consumers) in the European Union<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In this situation, the VAT applied depends on the type of operation and the total annual sales amount:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><td><strong>Customer Type<\/strong><\/td><td><strong>Applicable VAT Regulation<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Goods and Digital\/Telecommunications Services<\/strong><\/td><td>The <strong>VAT of the country of destination<\/strong> (where the individual resides) applies from the first euro.<\/td><\/tr><tr><td><strong>Distance Sales of Goods and General Services<\/strong><\/td><td><strong>\u20ac10,000 Net Threshold:<\/strong> The total value of distance sales of goods and digital\/telecommunications services to all private customers in the EU must be calculated.<\/td><\/tr><tr><td><strong>\u00b7 If the \u20ac10,000 threshold is NOT exceeded<\/strong><\/td><td><strong>Spanish VAT<\/strong> <strong>applies<\/strong>, and the operation is declared as a normal domestic sale (Form 303).<\/td><\/tr><tr><td><strong>\u00b7 If the \u20ac10,000 threshold IS exceeded<\/strong><\/td><td>It is mandatory to apply the <strong>VAT of the country of destination<\/strong> (the buyer&#8217;s country).<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<ul>\n<li><strong>One Stop Shop Scheme (OSS):<\/strong> If you exceed the \u20ac10,000 threshold and must apply the destination country&#8217;s VAT. To avoid registering in every country, you can register for the <strong>One Stop Shop (OSS) Scheme<\/strong> in Spain.\n<ul>\n<li>The OSS allows you to declare and pay the VAT for all EU countries in a single quarterly declaration in Spain (<strong>Form 369 &#8211; Modelo 369<\/strong>), greatly simplifying management.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Note:<\/strong> These invoices are<strong> not<\/strong> <strong>included in Form 349<\/strong>, as this is only for operations with professionals\/businesses.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Customers_Outside_the_European_Union_Exports\"><\/span><strong>3. Customers Outside the European Union (Exports)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>When the invoice is issued to a customer (individual or company) outside the European Union:<\/p>\n\n\n\n<ul>\n<li><strong>VAT:<\/strong> The operation is exempt from VAT (Art. 21 of the VAT Law applies). The invoice is issued <strong>without VAT<\/strong>.<\/li>\n\n\n\n<li><strong>IRPF:<\/strong> <strong>IRPF <\/strong>(Personal Income Tax retention)<strong> is not included<\/strong> (retention only applies between professionals residing in Spain).<\/li>\n\n\n\n<li><strong>ROI:<\/strong> <strong>It is not necessary<\/strong> to be registered in the ROI.<\/li>\n\n\n\n<li><strong>Invoice:<\/strong> Issuing an invoice to a non-EU customer is very <strong>simple<\/strong>. You only need to include the price of the products or services to be charged and the reference to the VAT exemption.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"In_Summary\"><\/span><strong>In Summary<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Based on what we have seen, the <strong>key factors<\/strong> to consider when invoicing customers who are not in Spain are:<\/p>\n\n\n\n<ul>\n<li>Whether you are offering <strong>a product or a service<\/strong> (and its nature, e.g., digital or general).<\/li>\n\n\n\n<li>Whether your customer is in an <strong>EU country or outside of it<\/strong>.<\/li>\n\n\n\n<li>Whether your customer is a <strong>company\/freelancer<\/strong> or a <strong>private individual<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>This will influence whether you have to add any tax like VAT, the obligation to register for the <strong>ROI<\/strong>, and, in the case of private EU customers, whether you must opt into the <strong>One Stop Shop (OSS) Scheme<\/strong>.
