To do this, deductible expenses directly associated with the property are subtracted from the income received to obtain the <strong>net rental income<\/strong>. After applying the relevant reductions, this becomes the taxable base.<\/p>\n\n\n\n<p>As it is a progressive tax, <strong>the tax increases according to the taxable base.<\/strong> The applicable tax brackets are as follows:<\/p>\n\n\n\n<ul>\n<li><strong>Up to 12,450 <\/strong>euros, where a 19% <a>tax is paid<\/a>.<\/li>\n\n\n\n<li><strong>Up to 20,199 <\/strong>euros with a tax rate of 24%.<\/li>\n\n\n\n<li><strong>Up to 35,199 <\/strong>euros taxed at 30%.<\/li>\n\n\n\n<li><strong>Up to 59,999 <\/strong>euros, where a 37% tax is paid.<\/li>\n\n\n\n<li><strong>Up to 299,999 <\/strong>euros with a 45% tax rate.<\/li>\n\n\n\n<li><strong>Starting at 300,000 <\/strong>euros at 47%.<\/li>\n<\/ul>\n\n\n\n<p><strong>If the lease is for primary residence, the owner may apply a tax reduction <\/strong><strong>on the net income. <\/strong>This reduction ranges <strong>from 50% to 90%,<\/strong> depending on factors such as whether the property is in a stressed market area, the tenant&#8217;s age, or recent renovations.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Value_Added_Tax_VAT\"><\/span>Value Added Tax (VAT)<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p><strong>It is an indirect tax that is applied to consumption <\/strong>and taxes the supply of goods and services by companies and professionals, intra-community acquisitions of goods and the importation of goods.<\/p>\n\n\n\n<p>In the case of residential rentals, <strong>this tax is only payable when the rented property is not used as a primary residence.<\/strong> For example, commercial premises or tourist accommodation.<\/p>\n\n\n\n<p>The applicable Value Added Tax (VAT) rate is<strong> 21% of the rental amount.<\/strong><\/p>\n\n\n\n<p>In addition to these two taxes, the owner is responsible for the <strong>Property Tax (IBI)<\/strong>. This is a direct tax on property ownership; for rental properties, it is considered a <strong>deductible expense<\/strong> when calculating net rental income.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consequences_of_not_declaring_rental_income_from_an_apartment\"><\/span>Consequences of not declaring rental income from an apartment<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>If, whether by mistake or intentionally, rental income is not declared, you should know that <strong>it will not go unnoticed.<\/strong><\/p>\n\n\n\n<p>Failure to declare income earned from renting a home <strong>can have legal and financial consequences,<\/strong> including fines ranging from 50% to 150% of the undeclared amount.<\/p>\n\n\n\n<p>The amount of these fines<strong> varies in proportion to the severity of the infraction:<\/strong><\/p>\n\n\n\n<ul>\n<li><strong>Minor fines.<\/strong> This is the least serious case, applied when the undeclared amount is less than 3,000 euros, provided there was no deliberate concealment. The fine is a maximum of 50% of the amount defrauded.<\/li>\n\n\n\n<li><strong>Serious fines.<\/strong> These fines will be applied when the amount exceeds 3,000 euros and it is proven that there was an intention to conceal the information. In this case, the fine ranges from 50% to 100%.<\/li>\n\n\n\n<li><strong>Very serious fines.<\/strong> The most serious cases will occur when fraudulent means are used, such as false documents or simulated accounting structures. In this case, the fine can be increased to up to 150% of the undeclared amount.<\/li>\n<\/ul>\n\n\n\n<p>In addition to paying the fine for non-compliance, <strong>the owner will also have to pay the tax owed, including late payment interest<\/strong> to the Tax Agency for the time that has passed since the payment should have been made.<\/p>\n\n\n\n<p>Therefore, a rental agreement signed by a homeowner granting the use of their property to another person in exchange for payment is subject to taxes. The primary tax is Personal Income Tax (IRPF). However, if the property is not used as a permanent residence (e.g., short-term or commercial rentals), the lease is not exempt from Value Added Tax (VAT) and will be subject to a 21% rate.
