When we think about buying a home, we often focus solely on the exchange between the buyer and the seller. However, for a smooth and successful experience, several experts intervene to provide value at every stage of the transaction.
Advisory and Search Phase
Real Estate Agent
Acts as the ideal connector between the buyer and the seller. Their primary benefit is the saving of time and effort, as they use their market knowledge to find a fair price and the property that best suits your needs and budget.
Lawyer / Solicitor
Your greatest guarantee of legal certainty. Their mission is to defend your interests, ensuring every step is taken in accordance with the law. They provide the peace of mind of knowing that the legal status of the property is fully transparent before you commit.
Tax Advisor
Their intervention allows you to optimize your investment. A tax expert analyzes your case so that the tax burden is as favorable as possible within the law. Their work includes, among others, the settlement of ITP (Property Transfer Tax) for resale homes, or VAT (IVA) and AJD (Stamp Duty) for new builds.
Technical and Financial Validation Phase
Architect
Provides an expert vision regarding the potential and condition of the property. They are essential for renovation or construction projects, ensuring your future home meets all technical and regulatory standards. If no major works are required, their hiring is optional.
Financial Institution or Bank
Provides the necessary resources to make the purchase a reality. Their feasibility analysis gives you a clear perspective of your financial capacity, helping you secure the best possible financing conditions. If you do not require a mortgage, this figure is dispensable.
Appraiser (Valuer)
Provides an objective and professional valuation report of the property based on the current market. This report is mandatory to obtain a mortgage and optional (but recommended) if you do not need a loan.
Formalization and Registration Phase
Notary Public
As a public official, the Notary guarantees the absolute legitimacy of the operation. Signing before a Notary is mandatory for the contract to be final and effective, allowing for its official recording.
Land Registry (Registro de la Propiedad)
The institution that grants you official recognition as the owner against third parties. Although registration is technically voluntary, it is fundamental for obtaining definitive legal protection and ensuring your rights are state-protected.
The Cadastre (Catastro)
Works in tandem with the Land Registry to physically define the property boundaries and establish the values used for local tax management, providing administrative transparency to your property.
Administrative Agent (Gestoría)
Responsible for the efficiency of post-completion procedures. They handle the administrative tasks after the signing (such as tax payments and the submission of Title Deeds), ensuring the process is seamless and uncomplicated for you.
Estimated Costs
To ensure your financial planning is accurate, these are the standard ranges in Spain:
- Lawyer: Usually ranges between 1% and 1.5% of the purchase price, depending on the complexity of the transaction.
- Notary and Registry: Regulated by official state fees. Combined, they usually represent between 0.5% and 1% of the property value.
- Administrative Agent: Fixed fees for administrative management, normally between €300 and €600 for the full processing of deeds and taxes.
- Appraisal: If applying for a mortgage, the cost is usually between €300 and €800, depending on the size and value of the home.
- Real Estate Agent: In many areas of Spain, commission (usually between 3% and 5%) is typically paid by the seller, though it is essential to confirm this in each specific case.
Important Note: These costs are general estimates. Taxes (ITP or VAT) vary depending on the Autonomous Community and the buyer’s personal circumstances.
