Managing an inheritance in Spain involves high technical complexity due to the coexistence of state and regional regulations. There is no single solution; reducing the taxable base depends on a detailed analysis of the assets, the degree of kinship, and the actions taken prior to the death.

Ways to avoid paying inheritance taxes

The first thing to make clear at this point is that there is no single way to reduce tax payments that can be applied to everyone. Each case, inheritance, deceased person, and heir will have to be analyzed in detail.

It can also vary depending on the actions they have taken previously.

Inheritance Tax Reductions

As we mentioned earlier, there are reductionsin Inheritance Tax in some cases:

  • When heirs have a disability. People with a legally recognized disability have access to specific tax benefits depending on the degree of the disability.
  • Cohabitation. If the heirs have lived with the deceased for at least the last two years, the tax is reduced by a maximum of 95%. This is usually the case for the spouse or descendants.
  • Transfer through a family business. For direct heirs, it is possible to apply a reduction of up to 99% on the tax linked to the business activity or shares. This is achieved by organizing and distributing assets in a way that maximizes tax benefits and minimizes Inheritance Tax.
  • Historical and artistic heritage. The transfer of assets included in the Spanish historical heritage is very specific and must be studied carefully.
Avoiding or delaying Inheritance Tax

Beyond reductions, there are strategies to mitigate the immediate financial impact:

  • Lifetime gifts. This option is the most cost-effective, allowing you to donate the assets you wish to transfer during your lifetime (for those over 65). This way, you pay approximately 5% compared to the 10% paid in Inheritance Tax.
  • Extending the payment deadline. While not a saving in itself, it is an interesting option to extend the usual 6-month Inheritance Tax deadline by an additional 6 months. This is done through a tax extension and serves to obtain liquidity through the assets received to pay the tax.
  • Exemptions by amount. For some heirs whose inherited estate is between 16,000 and 100,000 euros, there may be no obligation to pay this tax.
