Information on financial aid for workers affected by ERTES due to Covid-19

On 29 January, the Generalitat Valenciana approved DECREE 18/2021, of 29 January, of the Consell, on the approval of the regulatory bases and direct granting of aid for workers affected by an ERTE derived from the health crisis due to Covid-19. Due to the worsening of the Covid-19 health crisis, there has been a considerable increase in the number of work contract suspensions and reductions in working hours for economic, technical, organisational or production reasons, or due to force majeure (Temporary Employment Regulation Files -ERTE-) as a result of Covid-19, with the consequent reduction in income that determines the need to establish urgent and extraordinary aid to complement the corresponding benefits for workers affected by these ERTEs to alleviate this reduction.

This aid is provided through the payment of a monthly supplement both to workers who are still in a situation of ERTE and to those who may be affected by the new impediments or limitations in the development of normalised economic activity.

Who can receive the aid?

Beneficiaries and requirements

1. The beneficiaries will be natural persons who meet the following criteria requirements:
   a) They must be employed workers. Persons who are included within the scope of application of the revised text of the Workers’ Statute, approved by Royal Legislative Decree 2/2015, of 23 October, will be considered to hold this status.
   b) That the Social Security contribution account code of the work centre where they provide their services corresponds to the code of a province in the Comunitat Valenciana.
   c) That they are in receipt of unemployment benefit due to the temporary suspension of the employment contract, in its entirety, as a result of an ERTE for economic, technical, organisational or production reasons or due to force majeure arising from Covid-19.
2. In view of the social nature of the subsidy, the small individual amount of the aid, the large number of potential beneficiaries and the fact that they are employees, the prohibitions laid down in Article 13(2) of Law 38/2003 of 17 November 2003 are not applicable.
3. The provisions of Article 30(7) of Law 38/2003 of 17 November 2003 apply to this aid.

What is the amount of the aid?

The amount of the aid will amount to:

a) A maximum of 300.00 euros per beneficiary person in the event that they have been recipients of unemployment benefit associated with ERTE Covid-19 in the months of January and February 2021.

b) A maximum of 150.00 euros per beneficiary if they have been receiving unemployment benefit associated with ERTE Covid-19 during the month of January or during the month of February 2021.

What do you have to do to receive the aid?

Workers will not have to take any steps, as the aid will be processed automatically.

Resolution

The award decision will approve the list of beneficiaries and will indicate, except in the case of a partial decision, the contribution base and, where applicable, the date of birth, which have determined the cut-off of the aid.

The deadline for reaching a decision shall be three months from the day following the date of publication of these regulatory bases.

The resolution will be published in the Official Journal of the Generalitat Valenciana and the list of beneficiaries will appear in due course on the website of the Generalitat (see here), in the section corresponding to the Department of Sustainable Economy, Productive Sectors, Trade and Labour.
