The procedures for obtaining work permits will be much easier for foreigners who are outside Spain: they can be carried out telematically and the requirements for self-employment have been reduced.

Recently, some novelties have been introduced in the Spanish Immigration Law, some of which are aimed at facilitating the incorporation of foreign workers as self-employed in the Spanish labor market.

These are the main new features and facilities introduced by the new regulations of the Law on Foreigners, in force since August 16.

Simplification of hiring processes

The reform makes it possible to offer a 4-year work visa that will allow foreigners to be employed in national territory. This does not apply to the general residence and employment authorization. It is only for the collective management of hiring at origin.

Promotion of self-employment

Since the last legislative change, the cases in which self-employment authorization is granted have been extended, while the requirements for accessing this type of authorization have been reduced.

Temporary 4-year cards

Another new feature that contributes to promote self-employment is that the initial temporary cards are now renewed every 4 years, as opposed to the previous 2 years, and the authorization to work on one’s own account throughout the national territory is included.

Flexibility for students

The requirements previously established regarding income in order to establish oneself as a self-employed person are eliminated. This will make it easier for foreign students to work during their stay in Spain.

Easing of the social and family roots requirements

Since last August, it is no longer required to have a one-year contract in order to obtain the social roots, it is only necessary to have a contractual relationship with a weekly working day that must not be less than thirty hours in the global computation, in addition to guaranteeing at least the minimum interprofessional salary.

The reform also extends the figure of family roots to several cases, among others, to persons who provide support to others with Spanish nationality for the exercise of their legal capacity.

New roots due to training

Likewise, a new figure of “arraigo por formación” is created, which will provide a one-year residence permit for training in occupations in which labor is needed, and which will allow work if an employment contract is subsequently obtained. The requirement to obtain it is to prove a minimum continuous stay in Spain of two years.

Simplification of bureaucratic procedures

In addition to all the above, the reform of the Immigration Law simplifies some bureaucratic procedures by offering the possibility of applying for a visa telematically, whereas previously those who were abroad had to go to the consular office in person. In addition, it extends the duration of the renewal period of the family reunification card, speeds up the resolution of foreigners’ cases, and facilitates the initial authorization for temporary residence and self-employment.

Encouraging entrepreneurship

In order to encourage entrepreneurship, in the scope of renewals, there is now maximum compatibility between employment and self-employment, extending the validity of the renewed permit for foreigners up to 4 years.
